resolution, if
this was not for

forum. Indeed,
no one likes
disputes or
seeks any
‘comfort’ in it,
but, probably,
heads of
litigation
groups in law
firms. So, we
want to
encourage the
tigers of
international
arbitration and
the lions of
domestic
litigation to
finally disclose
their
preferences:
• Why would you
advise your
clients to
choose this or
that
jurisdiction or
arbitration,
while this
choice is still
possible, i.e.
while defining a
dispute
resolution
clause in the
international
contracts?
• Where are the
judges or
arbiters more
sensitive and
open to the best
arguments?
• Where and when
the access to
the court and
the proceedings
would better
serve the goals
of the clients?
• Once having
the ruling
secured – how
better to
enforce it?
By soliciting
‘your favorite’
forum, we expect
the litigating
lawyers to be as
opportunistic as
possible:
promote your
jurisdiction,
argue, trade
figures,
negotiate
preferences,
point at – the
forum shop is
open.
